Adviser criteria

What an adviser must meet to be listed

These are the published criteria for listing a lawyer, notary or tax adviser. No advisers are listed yet: this page says what we will ask for and check before anyone is.

  1. Professional registration

Advisers must be currently registered with the regulator for their profession in their own jurisdiction. For the current UK–Spain corridor, for example, advisers in Spain are most commonly registered with a Colegio de Abogados (through the Censo General de Letrados) for abogados, or the Consejo General del Notariado for notaries. Advisers in the UK must be authorised by the Solicitors Regulation Authority (SRA) or, for tax specialists, be members of the Chartered Institute of Taxation (CIOT). An adviser without current registration cannot be listed.

  2. Disciplinary status

Before a listing goes live we will check the adviser’s disciplinary record on their regulator’s public register, and we will re-check it regularly. An adviser under an active disciplinary sanction will not be listed.

  3. Cross-border experience

A general probate or tax practice is not enough. Advisers must show current experience of matters in the corridor they want to be listed for, such as UK–Spain: cases they are handling or have handled in that corridor, not incidental exposure.

  4. STEP membership

Membership of STEP (the Society of Trust and Estate Practitioners) is not required. Where an adviser holds it, we may show it on their listing once we have checked it.

  5. Credentials checked at source

Each credential shown on a listing, such as the regulator, the registration number and the disciplinary status, will be checked against the regulator’s own published register and not taken from the adviser’s application alone.

What listing means. Meeting the criteria is a condition of being listed. It is not an assessment of the quality of an adviser’s work, not a recommendation, and not legal advice. Advisers are independent of CrossBorder Estate.

If you are a lawyer, notary or tax adviser who meets these criteria, you can apply to be listed.
